Terms and Conditions

Below you will find our Terms and Conditions. These apply whenever you use or place an order through our website. The Terms and Conditions contain important information for you as a buyer. Please read them carefully. We recommend saving or printing these conditions for future reference.

  2. Website: The website of Beautyfashionshop.com, accessible via beautyfashionshop.com, including all associated subdomains.
  3. Customer: Any individual or entity, acting either personally or professionally, who enters into an Agreement with Beautyfashionshop.com or has registered on the Website.
  4. Agreement: Any arrangement or agreement between Beautyfashionshop.com and the Customer, of which these Terms and Conditions form an integral part.
  5. Terms and Conditions: The present Terms and Conditions.

Article 2. Applicability

  1. These Terms and Conditions apply to all offers, Agreements, and deliveries by Beautyfashionshop.com, unless otherwise expressly agreed upon in writing.
  2. Any conditions set by the Customer that deviate from or are not included in these Terms and Conditions are binding only if expressly accepted in writing by Beautyfashionshop.com.
  3. If specific product or service conditions apply in addition to these Terms and Conditions, the Customer may invoke the provision that is most favorable to them in the event of conflicting conditions.

Article 3. Prices and Information

  1. All prices on the Website and in materials from Beautyfashionshop.com include VAT and, unless otherwise stated, any additional government-imposed charges.
  2. While we take the utmost care to ensure the accuracy of the Website content, Beautyfashionshop.com cannot guarantee that all information is correct and complete. All prices and other information are subject to obvious programming and typographical errors.
  3. Beautyfashionshop.com cannot be held responsible for any discrepancies in color due to screen display quality.

Article 4. Formation of Agreement

  1. The Agreement is concluded when the Customer accepts the offer from Beautyfashionshop.com and complies with the conditions set by Beautyfashionshop.com.
  2. If the Customer accepts the offer electronically, Beautyfashionshop.com will confirm receipt of the acceptance electronically without delay. Until this confirmation is received, the Customer may dissolve the Agreement.
  3. If incorrect information was provided by the Customer during the acceptance or conclusion of the Agreement, Beautyfashionshop.com has the right to fulfill its obligations only after receiving the correct information.
  4. Beautyfashionshop.com may, within legal limits, check the Customer's ability to meet payment obligations and other relevant facts to responsibly enter into the Agreement. Based on this investigation, Beautyfashionshop.com reserves the right to refuse an order or attach special conditions, such as advance payment.

Article 5. Execution of Agreement

  1. After receiving an order, Beautyfashionshop.com will ship the products as soon as possible, subject to the provisions of paragraph 3 of this Article.
  2. Beautyfashionshop.com is entitled to engage third parties in fulfilling its obligations under the Agreement.
  3. The Website will provide clear information before the Agreement is concluded regarding delivery methods and timelines. If no delivery term is agreed upon, the products will be delivered within 30 days.
  4. If Beautyfashionshop.com cannot deliver within the agreed period, the Customer will be informed and may agree to a new delivery date or dissolve the Agreement free of charge.
  5. Customers are encouraged to inspect delivered products promptly and report any defects within a reasonable timeframe, preferably in writing.
  6. Risk for the products transfers to the Customer once the products are delivered to the specified address, unless otherwise agreed.

Article 6. Right of Withdrawal

  1. This Article applies only to Customers who are natural persons and not acting in a professional capacity.
  2. Customers have the right to withdraw from the Agreement within 14 days without giving reasons.
  3. The withdrawal period starts the day after the Customer or a third party (not the carrier) receives the product.
  4. Customers bear the cost of return shipping unless these exceed the standard postal rate. In such cases, Beautyfashionshop.com will estimate the costs.

Article 7. Payment

  1. Payments must be made according to the methods specified during the ordering process.
  2. Beautyfashionshop.com reserves the right to modify available payment methods.
  3. Late payments will incur statutory interest, and Beautyfashionshop.com may charge collection fees as permitted by law.

Article 8. Warranty and Conformity

  1. Beautyfashionshop.com guarantees that products comply with the Agreement, the specifications listed, and reasonable usability standards.
  2. Any defects must be reported promptly, allowing Beautyfashionshop.com to repair, replace, or refund the product.

Article 9. Complaints Procedure

  1. Complaints regarding products or services should be reported to Beautyfashionshop.com via phone, email, or post.
  2. Complaints will be addressed within 14 days. If a substantive response cannot be provided within this period, Beautyfashionshop.com will indicate when the complaint will be resolved.
  3. Consumers can also submit complaints via the European ODR platform: http://ec.europa.eu/odr.

Article 10. Liability

  1. Beautyfashionshop.com’s total liability for damages is limited to the price of the product(s) purchased.
  2. Beautyfashionshop.com is not liable for indirect damages, such as lost profits or data loss, unless caused by intent or gross negligence.

Article 11. Personal Data

  1. Beautyfashionshop.com processes personal data in accordance with its Privacy Policy.

Article 12. Final Provisions

  1. Dutch law applies to all Agreements.
  2. In case of disputes, the competent court in the district of Beautyfashionshop.com’s registered office will have jurisdiction, unless mandatory law states otherwise.
  3. If any provision of these Terms and Conditions is found invalid, the remaining provisions will remain in effect.
